These Terms of Use (“Terms”) apply to your access and use of ActionLogics (“Software”) provided by Cravety LLC (“Company”, “we”, “us”, or “our”) and the customer (“Customer”) of the Company on whose behalf the service is provided.
Please read them carefully before using the Software.
By using the Software, you agree to be bound by the terms of this Agreement, our Terms of Service, and our Privacy Policy. If you do not agree with any of these, please do not use the Software.
1. Acceptance of Terms
By accessing or using the Software, you agree to be bound by these Terms, our Terms of Service, and our Privacy Policy, as updated from time to time.
2. User Conduct
You agree not to use the Software in a way that:
- Violates any laws or regulations,
- Violates the rights of any third party, including copyright, trademark, privacy, or other personal or proprietary rights,
- Is abusive, disruptive, threatening or harassing,
- Interferes with the operation or any user’s enjoyment of the Software.
3. User Content
You are solely responsible for all data, information, and other content that you upload, post, or otherwise transmit via the Software. We take no responsibility and assume no liability for any user content.
4. Intellectual Property
All content included in the Software, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Software, is the property of the Customer and is governed by the Customer’s Terms of Service and Privacy Policy.
All functionality included in the Software, such as the compilation, and any software used on the Software, is the property of the Customer or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights.
5. Modification and Termination of the Software
We reserve the right at any time to modify or discontinue, temporarily or permanently, the Software (or any part thereof) with or without notice. You agree that the Company shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Software.
6. Disclaimer of Warranties
You expressly understand and agree that your use of the Software is at your sole risk. The Software is provided on an “AS IS” and “AS AVAILABLE” basis.
7. Limitation of Liability
In no event shall the Company be liable for any indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses arising out of or in connection with the use or inability to use the Software.
8. Changes to the Terms of Use
We reserve the right, at our sole discretion, to change, modify, add, or remove portions of these Terms at any time. Your continued use of the Software following the posting of changes will mean that you accept and agree to the changes.
Terms of Use is effective from 6/19/22.
